1 Introduction

Any terms in capital not defined in this Acceptable Use Policy (Policy) shall have the same meaning as in the terms and conditions of your contract with us (General Terms). This Policy applies to you and any third-party Users of the Service.

In this Policy, references to we, us and our are to Aiir Networks Limited and a reference to the Service means broadband connectivity or access to a LoRaWan or alternative protocol derived network for sensing technologies.

2 Updates to this Policy

2.1 We may need to change this Policy from time to time. The latest version of the Policy will always be posted on our website at https://www.aiirnetworks.co.uk/acceptable_use_policy and it is your responsibility to keep up to date with any changes made.

3 Aim of this policy

3.1 We are committed to protecting and promoting safe, responsible and legal use of our Service.

4 Acceptable Use

4.1 We permit you to use our Service for only for legitimate and lawful business and commercial purposes (or where you are a consumer legitimate and lawful personal use) and any other purposes expressly agreed in your Contract. Use of the Service in any other way, including in contravention of any restriction on use set out in this Policy, is not permitted. If you do not agree with the terms of this Policy you may not use our Service.

Service

4.2 You will not use the Service in any manner which, at our absolute discretion, we consider to be:

4.2.1 in breach of the terms of the Contract;

4.2.2 fraudulent or dishonest or in violation of any Law, licence, code of practice, instructions or guidelines issued by a regulatory authority;

4.2.3 defamatory, offensive, abusive, indecent, obscene, or in any manner that constitutes towards harassment or detriment to any person or which violates or otherwise encroaches on the rights of others (including rights of privacy and free expression);

4.2.4 promoting or encouraging of illegal, socially unacceptable or irresponsible behaviour, or that may be otherwise harmful to any person or animal;

4.2.5 in breach of our Intellectual Property Rights, or the right of any person, for example by using or distributing or copying protected or ‘pirated’ material without the express permission of the owner;

4.2.6 in breach of privacy or data protection rights of any person;

4.2.7 detrimental to our ability to provide the Services to you or any other customer of ours; or

4.2.8 damaging to our brand or reputation.

Security

4.3 You must not:

4.3.1 send, receive, store, distribute, transmit, post, upload or download any materials that are designed to violate our network’s security or any third party’s system or network security, nor take any action that could:

4.3.1.1 damage, interfere with, weaken, destroy, disrupt, harm, violate, disable, overburden, overtake, compromise, hack into or otherwise adversely affect any computer system, network or the internet access of our network or the network of any other company or person; or

4.3.1.2 adversely affect or tamper with the security or network of any of our systems or the systems of any other company or person.

4.3.2 access any computer system or network belonging to any company or person for any purpose without permission, including to probe, scan or test the security of a computer system or to monitor data traffic;

4.3.3 connect our network to machines, equipment or services that do not have adequate security protection or that are able to be used by others to carry out conduct that is not allowed by this Policy; or

4.3.4 collect, take or harvest any information or data from the Service, our systems or network, or attempt to undermine any of our servers or systems that run the Service.

Communication

4.4 When using the Service to communicate with others (by whatever means), you will not:4.4.1 communicate in any way that we believe to be:

4.4.1.1 spam;

4.4.1.2 likely to cause annoyance, inconvenience, distress, offence or anxiety to any person;

4.4.1.3 likely to damage, harm, ruin, or affect the enjoyment of any person; or

4.4.1.4 offensive on the grounds of race, sex, religion, nationality, disability, sexual orientation, age, or any other protected or similar categorisation.

4.4.2 impersonate or otherwise misrepresent another person, or help others to do the same, which includes faking, forging, or hiding email headers, subjects, sender details or caller ID details;

4.4.3 send unsolicited communications such as unsolicited bulk emails or text messages, ‘mailbombs’, nuisance calls or advertising; or

4.4.4 send any emails, make any calls or communicate with any other company or person in any way that may suggest, indicate or imply that you are employed by, or otherwise associated, with us.

5 Your Responsibilities

5.1 You are responsible for complying with the terms of this Policy and for ensuring that all Users of the Service comply with this Policy.

5.2 You are responsible for all materials and/or data originating from the machines and/or networks that you have connected to our network. If we notify you that we consider you to be breaching is requirement, you must immediately disconnect (and subsequently secure prior to reconnection) machines generating materials and/or data that contravene this Policy.

6 Our Rights

6.1 In the event that we reasonably consider you may have breached the terms of this Policy, we reserve the right to take any action that we deem appropriate, including but not limited to:

6.1.1 investigating the possible breach and using your personal information to contact you by email or phone to gather further information, discuss our concerns, or issue you with a formal warning;

6.1.2 run network and computer systems to find and resolve issues covered by this Policy; and

6.1.3 exercising any rights we have in the General Terms regarding your breach, including without limitation suspending the Service and terminating the Contract with you.

6.2 In serious cases, we can report you to the police or other law enforcement agency, and give them your personal information.
